Do you ever wonder whether you are giving legal advice or providing legal services to a donor or potential donor?  Did you know that providing legal advice or services constitutes the unauthorized practice of law?  This session will provide clarity on what activities constitute the practice of law and tips for identifying when you should involve an attorney.

Making Charitable Bequests Stick

Litigation involving trusts and estates is a cumbersome process and can seriously dissipate a charitable bequest. Surely this is not the legacy your donor intends to leave!  To add insult to injury, litigation can often be mitigated or altogether avoided through a proper, thoughtful, and perhaps creative, estate plan.  This session will focus on what charitable organizations can do to avoid trust and estate litigation and the rights of charitable organizations when litigation is unavoidable.

Bios:

Gregg Weinberg heads the litigation section of Roberts Markel Weinberg Butler Hailey PC. Mr. Weinberg’s practice focuses on complex commercial litigation, fiduciary litigation, financial cases and cases other lawyers might consider “odd.” He is Board Certified in both Civil Trial Law and Personal Injury Trial Law by the Texas Board of Legal Specialization. He is a member of the American Board of Trial Advocates (ABOTA) and has been listed on Thomson Reuters Super Lawyers Editions 2005-2008 and 2011-2013.

Aaron Dobbs heads the estate planning, probate and trust administration section of Roberts Markel Weinberg Butler Hailey PC. He focuses his practice on estate planning, trust and estate administration, fiduciary litigation, probate litigation, and guardianships.  Mr. Dobbs is board certified in estate planning and probate law by the Texas Board of Legal Specialization.  Mr. Dobbs routinely advises clients on the development of estate plans and assists fiduciary, corporate, and nonprofit clients in all aspects of estate, trust and guardianship matters and disputes before trial and appellate courts across the state of Texas.

Ms. Bentley is an attorney with Roberts Markel Weinberg Butler Hailey PC and focuses her practice on elder law, estate planning, trust administration, probate and guardianship.  She is board certified in estate planning and probate law by the Texas Board of Legal Specialization, in addition to being a Certified Elder Law Attorney by the National Elder Law Foundation.  Kelley is a VA accredited claims attorney. Ms. Bentley regularly advises clients on the preparation of estate planning documents, with an emphasis on the special needs of the elderly and individuals with disabilities.
